2. DD Luxe Is Not a Medical Provider
DD Luxe is a non-clinical concierge service.
DD Luxe and Dakota Davidson do not provide medical diagnosis, treatment or clinical care and do not act as your surgeon, doctor, nurse or other registered health practitioner.
DD Luxe does not:
-
Diagnose medical conditions.
-
Conduct clinical examinations or determine whether you are medically suitable for a procedure.
-
Prescribe medication or advise you to start, stop or change prescribed medication.
-
Select a procedure, implant, surgical technique or anaesthetic on behalf of you or your treating Provider.
-
Provide surgical consent or personalised clinical risk disclosure.
-
Provide nursing, rehabilitation or emergency medical care.
-
Guarantee the credentials, conduct, availability or results of an independent Provider.
-
Replace advice from an appropriately qualified medical practitioner.
-
Provide immigration, legal, tax or financial advice.
-
Provide travel insurance or confirm whether an insurance policy provides appropriate coverage.
-
Your treating medical practitioner is responsible for your clinical assessment, treatment recommendations, personalised risks and alternatives, informed consent and treatment decisions.
You are responsible for making your own final decision about whether to proceed with any Provider or procedure.
3. Independent Providers
Surgeons, clinics, hospitals, anaesthetists, medical practitioners, accommodation providers, airlines, transport providers and other third-party suppliers are independent from DD Luxe unless expressly stated otherwise in writing.
An introduction, referral, commercial relationship, coordination arrangement or communication facilitated by DD Luxe does not make an independent Provider an employee or clinical agent of DD Luxe.
Independent Providers remain responsible for their own services, professional obligations, clinical decisions, contracts, fees and conduct.
DD Luxe remains responsible for its own services, representations, contractual obligations and exercising reasonable care in providing its agreed concierge services.
4. Provider Research, Shortlisting and Introductions
Where included in your service, DD Luxe may research, compare, shortlist, introduce or recommend Providers for your consideration.
DD Luxe may consider information including a Provider’s:
-
Professional credentials and registration.
-
Relevant procedure experience.
-
Facility information.
-
Published results and aesthetic approach.
-
Location and practical considerations.
-
Availability.
-
Indicative pricing.
-
Information supplied directly by the Provider or available from other reasonably accessible sources.
A Provider’s inclusion in a DD Luxe shortlist or comparison does not constitute a guarantee of that Provider’s safety, clinical suitability, availability or results.
Provider information can change. DD Luxe will take reasonable care when making factual representations and will correct information it knows has become inaccurate or materially outdated.
You should independently confirm material information that is important to your decision, including current professional registration, qualifications, facility information, final pricing and the Provider’s proposed treatment plan.
Final clinical suitability must be determined by the treating practitioner.
5. Your Responsibilities
You agree to provide information requested by DD Luxe accurately and to the best of your knowledge.
Where relevant to your treatment, you must provide complete and accurate health information directly to your treating Provider and follow the Provider’s instructions.
You are responsible for:
-
Attending required consultations and assessments.
-
Asking your treating Provider questions about your proposed procedure.
-
Understanding the material risks, alternatives and expected recovery associated with treatment.
-
Reading Provider contracts, quotations, consent documents and cancellation terms before agreeing to treatment.
-
Checking passport, visa and immigration requirements applicable to your travel.
-
Obtaining appropriate travel insurance and determining whether it provides suitable coverage.
-
Following medical advice and seeking appropriate medical care where required.
-
Informing DD Luxe promptly of changes that may affect coordination of your agreed service.
-
DD Luxe should not be used as a substitute for communication with your treating medical team.
6. Fees and Payments
Fees payable to DD Luxe relate to DD Luxe’s own concierge services.
Your individual Service Schedule will specify the DD Luxe service fee, payment requirements and, where applicable, service stages or milestones.
Unless expressly agreed otherwise in writing, fees charged by independent surgeons, hospitals, clinics, airlines, accommodation providers and other third-party suppliers are separate from DD Luxe’s service fee and are paid directly to the relevant Provider or supplier.
Provider pricing supplied or discussed by DD Luxe may be indicative only.
Final treatment pricing and inclusions must be confirmed in writing with the relevant Provider before payment.
Cancellation and refund rights relating to DD Luxe services are addressed in our Refund & Cancellation Policy and any applicable Service Schedule.
7. Referral Fees and Commercial Relationships
DD Luxe may have commercial relationships with certain surgeons, clinics, hospitals or other Providers.
DD Luxe may receive a referral fee, commission, marketing fee or other commercial benefit from some Providers where a client proceeds with that Provider.
Where applicable, DD Luxe will disclose the relevant commercial relationship before you commit to the Provider, including the nature of the relationship and information about the benefit where known and reasonably practicable.
A commercial relationship does not mean that a Provider is clinically suitable for you and does not constitute regulatory approval or a guarantee of safety or results.
Where reasonably applicable, DD Luxe may also consider Providers with whom it does not have a financial relationship.
You remain free to choose another Provider.
8. Travel and Accommodation
Where travel or accommodation coordination forms part of your DD Luxe service, DD Luxe may assist with researching, organising or coordinating relevant arrangements.
Unless expressly agreed otherwise in writing, travel, accommodation and other third-party services are supplied by independent suppliers and are subject to their own terms, availability, cancellation policies and fees.
Travel arrangements may be affected by matters outside DD Luxe’s reasonable control, including flight disruptions, border requirements, weather, Provider scheduling and changes to your treatment plan.
You are responsible for ensuring that you hold appropriate travel documents and for considering appropriate travel insurance.
9. Overseas Cosmetic Surgery
Cosmetic surgery overseas may involve considerations different from receiving treatment in New Zealand.
These may include differences in:
-
Laws and regulation.
-
Professional registration systems.
-
Facility standards and oversight.
-
Privacy protections.
-
Complaint and compensation processes.
-
Follow-up and aftercare arrangements.
-
Access to your treating surgeon after returning home.
-
Travel-related health risks.
-
Insurance coverage.
-
Costs arising from complications, extended stays or changes in treatment.
Before proceeding, you should obtain an individual clinical assessment from an appropriately qualified practitioner, understand the Provider’s complication and aftercare pathway and consider obtaining independent medical advice in New Zealand where appropriate.
DD Luxe is not an emergency medical service.
If you experience symptoms requiring urgent medical attention, contact an appropriate medical provider or emergency service.
10. Provider Changes or Refusal of Treatment
A Provider may determine following consultation or assessment that a proposed procedure is unsuitable, should be changed or should not proceed.
Providers may also change availability, treatment plans, pricing or scheduling.
DD Luxe cannot override a Provider’s clinical decision.
If this occurs, DD Luxe may assist with non-clinical communication or coordination where this falls within your agreed service.
Any Provider refund is subject to the Provider’s applicable terms.
The effect on DD Luxe’s own service fee will be determined in accordance with your Service Schedule, our Refund & Cancellation Policy and applicable New Zealand law.
11. Photographs, Testimonials and Marketing
Purchasing or using a DD Luxe service does not automatically give DD Luxe permission to use your photographs, medical information, testimonial, story or identity for advertising or marketing.
DD Luxe will obtain separate, specific and voluntary permission before using identifiable client material for marketing purposes.
Where before-and-after photographs or testimonials are displayed by DD Luxe, they represent individual experiences or outcomes.
Individual results vary and no result is promised or guaranteed.
12. Privacy
DD Luxe handles personal information in accordance with its Privacy Policy and applicable New Zealand privacy law.
Because DD Luxe may assist with international coordination, your information may need to be provided to overseas Providers or suppliers.
Where required, DD Luxe will obtain appropriate authority before disclosing health information overseas.
Please read our Privacy Policy for further information about collection, use, storage, disclosure and overseas transfer of personal information.
13. Communications
You authorise DD Luxe to communicate with you using the contact details you provide for purposes reasonably connected with your enquiry or purchased service.
Where you specifically authorise DD Luxe to communicate with a Provider on your behalf, DD Luxe may facilitate administrative communications and transfer authorised information necessary for the agreed service.
This does not authorise DD Luxe to make clinical decisions or provide informed consent on your behalf.
Marketing communications will only be sent where permitted, and you may unsubscribe from marketing communications.
14. Information and Website Content
Information provided through the DD Luxe website, social media accounts, communications or general educational content is for general informational purposes.
It does not constitute personalised medical advice, diagnosis, clinical assessment or informed consent.
Provider information, prices, availability, regulations and travel requirements can change.
You should verify material information before relying upon it to make a final decision.
15. Limits of DD Luxe’s Responsibility
DD Luxe does not guarantee:
-
That a particular Provider will accept you as a patient.
-
That you are medically suitable for a procedure.
-
That a particular procedure will be recommended.
-
A particular surgical or aesthetic result.
-
That a Provider’s availability or pricing will remain unchanged.
-
That travel will occur without disruption.
-
That an insurer will provide coverage.
-
That complications will not occur.
Nothing in these Terms excludes or limits DD Luxe’s responsibility where doing so would be unlawful.
DD Luxe remains responsible for its own contractual obligations, representations and requirement to exercise reasonable care and skill when providing its services.
16. Consumer Rights
Nothing in these Terms & Conditions excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under applicable New Zealand law, including rights that may apply under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.
If there is an inconsistency between these Terms and a non-excludable legal right, the legal right will prevail.
17. Complaints
If you have a concern about a DD Luxe service, please contact:
Email: ddluxetours@gmail.com
DD Luxe will handle complaints in accordance with its Complaints Procedure.
Complaints concerning clinical treatment or the conduct of an independent medical Provider may need to be addressed directly with that Provider or the relevant professional or regulatory body.
Where it falls within your agreed service, DD Luxe may assist with administrative communication concerning a Provider complaint but does not determine clinical liability.
18. Changes to These Terms
DD Luxe may update these Terms & Conditions from time to time.
Material changes will be published with an updated effective date and will apply prospectively unless otherwise lawfully agreed.
The Terms and Service Schedule applicable when you purchase a DD Luxe service will govern that service unless a later change is lawfully agreed between you and DD Luxe.
19. Governing Law
These Terms & Conditions are governed by the laws of New Zealand.
Nothing in this clause prevents a consumer from exercising any rights they have under applicable law.
